Hakim menangkan tuntutan karyawan Hotel Gran Melia
JAKARTA: Pengadilan Hubungan Industrial Jakarta Pusat mengabulkan gugatan delapan karyawan Hotel Gran Melia Jakarta terhadap manajemen PT Suryalaya Anindita Internasional (pengelola Hotel Gran Melia). Dalam sidang pembacaan putusan, pada hari Selasa, majelis hakim yang diketuai Heru Pramono memerintahkan agar manajemen Hotel Gran Melia mempekerjakan kembali kedelapan penggugat pada posisinya semula. Selain itu, pihak tergugat juga diperintahkan membayar uang service terhitung dari Januari 2008 kepada para penggugat, yang besarnya sekitar Rp2 juta per bulan bagi setiap penggugat.

Kuasa penggugat dari Federasi Serikat Pekerja Mandiri (FSPM), Odie Hudiyanto, mengaku senang dengan putusan majelis hakim dalam kasus tersebut. Dalam pertimbangan hukum majelis hakim, katanya, manajemen perusahaan itu kalah karena mereka tidak bisa membuktikan alasan pemutusan hubungan kerja secara massal disebabkan perusahaan dalam kondisi merugi atau kesulitan keuangan. Di satu sisi, ucapnya, manajemen berdalih PHK dilakukan untuk rasionalisasi atau pengurangan karyawan. Akan tetapi, sambungnya, di sisi lain manajemen justru menambah jumlah karyawan ekspatriat.

Lebih lanjut, dia menyebutkan ada beberapa bukti yang menguatkan gugatan pihaknya antara lain? bukti surat skorsing dari tergugat pada penggugat, isi dari perjanjian kerja bersama (PKB), slip gaji Januari dan Februari 2008 yang membuktikan tidak adanya pembayaran uang service, serta ketentuan dalam UU Ketenagakerjaan. "Apabila putusan PHI [Pengadilan Hubungan Industrial] masih diabaikan, secara serius kami akan melakukan kampanye secara global terhadap Group Sol Melia yang berpusat di Madrid, Spanyol," ujarnya, saat dihubungi Bisnis, kemarin. Hingga berita ini diturunkan, Bisnis tidak berhasil menghubungi Manager HRD Hotel Gran Melia Muhammad Fahmi, untuk dimintai komentarnya mengenai putusan tersebut. Begitu juga dengan pesan singkat yang dikirim Bisnis kepadanya tidak mendapatkan jawaban.

PHK karyawan
Permasalahan antarkedua pihak berawal saat manajemen perusahaan itu mengeluarkan surat PHK terhadap 29 karyawan,? termasuk penggugat, pada 20 Juni 2007. Ketika itu, manajemen berdalih bahwa PHK dilakukan untuk rasionalisasi atau pengurangan karyawan. Sebanyak 21 karyawan menerima keputusan PHK tersebut dan dijanjikan akan dibebaskan dari kewajiban membayar cicilan utang di Bank DKI, sementara delapan karyawan lainnya (penggugat) menolak PHK tersebut.

Mengingat kisruh yang terjadi antara para karyawan dan pihak manajemen semakin meruncing, kedelapan karyawan yang menolak PHK tersebut akhirnya melayangkan gugatan melalui PHI Jakpus, pada Maret.
Selain gugatan melalui PHI Jakpus, FSPM sebagai afiliasi SPM Hotel Gran Melia juga melaporkan pada Polda Metro Jaya, mengenai dugaan tindak penggelapan uang iuran anggota serikat pada SPM Gran Melia Jakarta. Sebelumnya FSPM juga melaporkan permasalahan itu kepada DPRD DKI Jakarta. Laporan pada DPRD DKI Jakarta tersebut terkait dengan masalah kredit para karyawan di Bank DKI. (

Judge granted the demands of Hotel Gran Melia Workers
JAKARTA: Industrial Court Central Jakarta granted the suit of eight workers of Gran Melia Jakarta against the management of PT. Suryalaya Anindita International (management of Gran Melia Hotel). In the reading of verdict, on Tuesday, the council of judges, chaired by Heru Pramono, ordered the management of Hotel Gran Melia to rehire the eight plaintiffs to their original positions. The accused party was also ordered to pay the service money from January 2008 to the plaintiffs, with the amount of approximately Rp. 2 millions per month per person.

Odie Hudiyanto from FSPM (Federation of Independent Worker Union), who acted as the proxy for these plaintiffs, said that he was happy with the verdict. He said, according to the opinion of council of judges, the Management of PT. Suryalaya Anindita International lost the case because they could not proof that the company had suffered a financial lost, which caused the mass firing. He also said that Management of PT. Suryalaya Anindita International was equivocating by saying that the mass firing was to rationalize or to reduce the number of workers, but in the other side, they decided to hire more expatriates.

Moreover, he mentioned several evidences which affirmed his suit, such as the suspension letter from hotel management to the plaintiffs, the content of CBA, pay slip from January to February 2008 to proof that service money was not paid, and also some clauses in the Manpower Act. “If this verdict from The Industrial Court is still being ignored, then we will do a global campaign against Sol Melia Group which headquarter is in Madrid, Spain,” Odie said when Bisnis Indonesia called him yesterday. Until this news is released, Bisnis Indonesia still can’t contact the HRD Manager of Gran Melia, Muhammad Fahmi, to ask for his comment on the verdict. There was also no response to the short messages sent to him by Bisnis Indonesia.

Worker Dismissal
The conflict between these two parties started when management of PT. Suryalaya Anindita International issued a dismissal letter towards 29 workers, including the 8 plaintiffs, on June 20th, 2007. At that time, management reasoned that the dismissal was to rationalize or to reduce the number of workers. Twenty workers accept that decision, and management promised to release them from any obligations they have to pay monthly installment to Bank DKI, while another 8 workers (the plaintiffs) decided not to accept the dismissal.

Because the conflict between workers and management was getting worse, then these eight workers who refused the dismissal finally decided to file the case through The Industrial Court Central Jakarta in March. Other than the suit through The Industrial Court Central Jakarta, FSPM as the affiliate of SPM Hotel Gran Mahakam also file a report about their suspicion on embezzlement of union monthly contributions in SPM Hotel Gran Melia to Polda Metro Jaya. Before that, FSPM also had reported their suspicion on embezzlement to Jakarta Region Legislative Assembly. This report is linked to the issue of money loaned by worker in Bank DKI and their monthly installment problems.
